Please read these Terms carefully. They describe our service in general terms and work alongside any separate written agreement you may sign.
Agreement to these Terms
These Terms of Service ("Terms") govern your access to and use of the Contractor Shield website, forms, and services (collectively, the "Service"). By visiting this website, submitting a request, scheduling a consultation, or otherwise using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
These Terms are a general description of the Service. They do not create a construction contract and do not replace any separate written agreement you may enter into with Contractor Shield or with any contractor.
What Contractor Shield provides
Contractor Shield is an independent homeowner advisory and contractor-matching service. We help homeowners organize a project, identify contractors who may be appropriate for that project, obtain proposals, and compare information so the homeowner can make an informed hiring decision.
The Service may include:
- Helping you describe and scope your project
- Identifying contractors who may be appropriate candidates
- Coordinating and requesting proposals
- Organizing proposal information into a comparison
- Providing a Contractor Shield Report™ as a decision-support summary
- Providing a clear side-by-side comparison of the contractors you are considering
The specific tools, criteria, formats, and internal methods used to deliver the Service are proprietary to Contractor Shield. Nothing in these Terms or on this website discloses, licenses, or transfers those methods to you or any third party.
We are not a contractor
Contractor Shield does not perform, supervise, manage, or warrant construction, repair, installation, or landscaping work of any kind. Any work is performed by separate, independent contractors who are not employed or controlled by Contractor Shield.
Contractors are independent businesses responsible for their own licensing, insurance, permits, workmanship, scheduling, pricing, warranties, and compliance with applicable law. You are solely responsible for your final selection of a contractor and for any agreement you enter into with that contractor.
Evaluation, reports, and comparisons
Contractor Shield may review information that can include licensing, insurance, reviews, proposal details, experience, warranty information, and other project considerations. These processes are intended to support your decision-making. They are not a guarantee, certification, endorsement, or assurance of any contractor's performance, quality, pricing, availability, or results.
The Contractor Shield Report™ is a comparison and decision-support tool. Any designations, ranges, or sample materials are illustrative and comparative in nature. They are not promises of savings, quality, or outcomes, and any sample report shown is an example only — not an actual customer result.
Contractor Shield may update, refine, or change its tools, criteria, and methods at any time. The methodology behind our reports and comparison methods is confidential and proprietary and is not published or made available for reproduction.
Your responsibilities
When you use the Service, you agree to:
- Provide accurate and complete information about yourself and your project
- Independently review any contractor, proposal, contract, license, and insurance before you hire
- Make your own final hiring decision
- Read and rely on any separate written agreement for the specific terms that apply to you
- Use the Service and any materials we provide only for your own project and not for any competing or commercial purpose
Fees and separate agreements
Any fees, charges, conditions, selection periods, or other commercial terms that may apply to a particular engagement are set out in a separate written agreement provided at the appropriate time. Those written terms control. This website does not set pricing and should not be relied upon as a statement of fees.
We do not make blanket claims on this website about cost, savings, or the amount of any fee. Please refer to your written agreement, or contact us, for the terms applicable to your situation.
Intellectual property and confidentiality
The Contractor Shield name and logo, the Contractor Shield Report™, and all related website content, copy, graphics, layouts, forms, report designs, comparison methods, evaluation criteria, processes, and know-how are the exclusive property of Contractor Shield and are protected by copyright, trademark, trade-secret, and other laws.
You may not, without our prior written consent:
- Copy, reproduce, republish, or distribute our reports, comparisons, or website content
- Reverse engineer, derive, or attempt to reconstruct our evaluation criteria, comparison methods, or internal processes
- Use our materials to build, train, or operate a competing product or service
- Remove or obscure any proprietary or trademark notices
- Use automated means to scrape, harvest, or collect content or data from the Service
Our reports and comparisons are provided to you for the sole purpose of evaluating your own project. All rights not expressly granted are reserved. Our proprietary methods are confidential and are disclosed to no one; access to the Service does not grant any license to them.
Third parties and links
The Service may reference or link to third parties, including contractors, review platforms, scheduling tools, and other websites. We do not control and are not responsible for third-party content, services, pricing, or conduct. Your dealings with any third party are solely between you and that third party.
Disclaimers
The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or that any information will be accurate, complete, or current.
Contractor Shield makes no warranty or guarantee regarding any contractor's workmanship, pricing, timeline, availability, licensing status, insurance, or the outcome of any project.
Limitation of liability
To the fullest extent permitted by law, Contractor Shield and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising out of or relating to: the work, conduct, or omissions of any contractor; property damage, personal injury, delays, or cost overruns; disputes between you and any contractor; or your reliance on any report, comparison, or information provided through the Service.
Because construction decisions and outcomes are ultimately yours and are carried out by independent contractors, you agree that your use of the Service is at your own discretion and risk.
Indemnification
You agree to indemnify and hold harmless Contractor Shield from any claims, damages, liabilities, and expenses arising out of your use of the Service, your violation of these Terms, or your agreements or disputes with any contractor.
Governing law and disputes
These Terms are governed by the laws of the State of Tennessee, without regard to conflict-of-law principles. You agree that any dispute relating to the Service or these Terms will be handled in the state or federal courts located in Tennessee, unless a separate written agreement provides otherwise.
Before starting any formal proceeding, you agree to first contact us so we can try to resolve the matter informally.
Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Service after changes take effect means you accept the revised Terms.
